Terms of use

Written to be read. The theme throughout: this app measures sounds and tells you what it measured, nothing more. Back to the app.

What Neigh is, and is not

Neigh analyzes recordings and reports measurements: sounds located, their acoustic properties, and, where accuracy has been measured and published, a name for a call. It does not read your horse's mind, does not report emotions, and is not veterinary, training, or behavioral advice. If you are worried about a horse's health or behavior, talk to a veterinarian or a qualified professional, not an app.

Accuracy is published, and imperfect

Every number the app shows was measured against recordings labelled by people, and the methods page shows those measurements, including what the app misses. You agree that you are using a measuring tool with published error rates, not an oracle.

Your recordings stay yours

You own your clips. If you choose to share a sound, you give us permission to have a person review it and to use it to teach and evaluate the recognition system. That permission covers review and teaching, and nothing else. You can request deletion at any time.

Attaching a recording to a care-team link is a different permission and a narrower one. It lets us store that recording and serve it to whoever holds that link, for as long as the link works. We do not review it, we do not use it to teach or evaluate anything, and it is deleted when you take it off, when you stop sharing the horse, when the link expires, or when you delete the horse or your account.

Respect the animals and the people

Record where you are allowed to record. Do not use the app to harass people or stress animals. The Speak room plays real horse calls: play a call once, from a distance, never at a horse in distress, and stop if the horse gets upset. Playback is never for provoking a reaction.

Conduct in Friends

Your name, your horses’ names and your brag sheets are seen by your friends. Do not put anything abusive, hateful, sexual, threatening or illegal in them, and do not use Friends to harass or spam anyone. Anyone can report you or block you from the friend list, a friend request or a horse in the paddock. We read reports, and we may remove content that breaks these rules and end an account’s access to Friends, or to the app.

Our app, models and data

Neigh, the models inside it, and the data and content it is built from belong to us, or to the people who license them to us. Using the app gives you the use of them, not a copy of them.

Taking it apart. You may not reverse engineer, decompile or disassemble the app, or try to work out its source code, its models, their weights, or the data they were trained on.

Copying it by machine. You may not scrape, extract or copy the app’s models, data or content by automated means, such as a bot, a script or a crawler.

Building a rival. You may not use the app, or what it gives you, to build a model or a service that competes with it. Your own recordings, and what the app measured in them, are still yours to keep and to share.

Rights the law keeps for you. Where the law where you live gives you a right that an agreement cannot take away, such as the right to study software or decompile part of it so that another program can work with it, these limits apply only as far as that law allows.

This section applies to every version of Neigh, on the web, on Android and on iPhone. In the version from Apple’s App Store, Apple’s standard licence agreement sets limits of the same kind.

Payments

Reading your own recordings comes with Neigh Plus. There is no free allowance and no free trial. Without a subscription you can still set up a horse, look around the app, and read the sample clip that comes with it, in full, as often as you like. Neigh Plus and its price are shown plainly before any charge, and earned credits have no cash value. Paying never buys a better answer: both lengths of the plan get the same measurements, and a clip the app cannot read is never charged for.

Who you are buying from. Neigh Plus is sold as an in-app purchase in Apple’s App Store, and that is the only way to buy it. Apple handles the sale and takes the payment on our behalf, as our agent (or, in some countries, our commissionaire), and Apple’s purchase terms apply to it. We never see your card. If the app is ever sold through another store, that store’s rules will govern a purchase made there, and this page will say so before it happens.

What renews, and for how long. Neigh Plus is an auto-renewing subscription. It is one plan on two lengths: one week, or twelve months. The price for your country is shown on the purchase screen, in your own currency, before you buy anything, and Apple charges it to your Apple Account when you confirm the purchase. It renews at that same length until you cancel, and Apple charges the renewal within the 24 hours before the current period ends. To stop that happening, cancel at least 24 hours before the period ends. If the price ever changes, Apple tells you before it takes a renewal at the new one.

Cancelling. Cancel at any time in your App Store subscription settings. You keep the plan until the end of the period you have already paid for. Deleting your Neigh account does not cancel the subscription, and neither does deleting the app: only Apple can stop the billing, so cancel there first.

Asking for money back. Refunds are Apple’s to give. We cannot refund an App Store purchase and we cannot cancel a subscription for you, so we do not promise you either. Ask Apple at reportaproblem.apple.com. Write to us about anything else, including anything the app got wrong, and we will help where we can.

On the web there is nothing to buy. Neigh Plus is sold only in the App Store version. In a browser without a subscription, the app works as it does on a phone without one: you can look around and read the sample clip, but not your own recordings. We do not take card details anywhere, and no page of this app will ask you for one. If you want to be told when a plan can be bought, the app can take an email address for that one message and nothing else.

The legal paragraph, in plain words

The app is provided as is. To the maximum extent the law allows, we are not liable for decisions made based on its measurements; the measurements are inputs to your judgement, not replacements for it. If a court finds part of these terms unenforceable, the rest still applies.

If you got Neigh from Apple’s App Store

These terms are an agreement between you and us, the developer of Neigh. They are not an agreement with Apple. We, not Apple, are solely responsible for Neigh and what is in it.

Your licence. We give you a licence to use Neigh that you cannot transfer, on any Apple-branded product you own or control, as the Usage Rules in Apple’s Media Services Terms and Conditions allow. Under those rules, other accounts linked to yours through Family Sharing or volume purchasing may use it too.

Support. We alone are responsible for maintaining and supporting Neigh, as these terms say and as the law requires. Apple has no obligation at all to provide maintenance or support for it.

Warranty. We are responsible for any product warranty, written or implied by law, that is not effectively disclaimed. If Neigh fails to meet one, you can tell Apple, and Apple will refund the purchase price you paid for it, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Neigh. Any other claims, losses, liabilities, damages, costs or expenses that come from a failure to meet a warranty are ours alone, not Apple’s.

Claims about the app. We, not Apple, deal with any claim from you or anyone else about Neigh or your having or using it. That includes product liability claims, any claim that Neigh fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

Other people’s rights. If anyone claims that Neigh, or your having or using it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.

Where you may use it. You confirm that you are not in a country subject to a US Government embargo, or one the US Government has designated as “terrorist supporting”, and that you are not on any US Government list of prohibited or restricted parties.

Other services’ terms. When you use Neigh you must also keep to the terms of any other service it relies on, such as your mobile network, or Apple or Google when you sign in with them.

Apple can enforce these terms. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right (and is taken to have accepted the right) to enforce them against you as a third-party beneficiary.

Questions, complaints and claims about Neigh go to us, at the details under Contact below, not to Apple.
